Welcome to SMPSocial. These Terms and Conditions govern your access to and use of the SMPSocial website, services, products, account features, payment systems, and related support services.
By accessing our website, creating an account, placing an order, or using any SMPSocial service, you confirm that you have read, understood, and agreed to these Terms and Conditions.
Please read these Terms carefully before purchasing or using our services.
1. About SMPSocial
SMPSocial provides online social media marketing and promotional services, including services related to members, followers, views, reactions, likes, subscribers, engagement, and other digital promotional activities.
The specific features, quantities, estimated delivery times, refill conditions, limitations, and prices of each service are displayed on the relevant service or product page.
SMPSocial is an independent service provider. We are not owned, operated, endorsed, sponsored, or officially affiliated with Telegram, Instagram, Facebook, Meta, TikTok, YouTube, X, Google, or any other third-party social media platform unless expressly stated otherwise.
2. Acceptance of These Terms
By using SMPSocial, you agree to be legally bound by these Terms and Conditions, our Privacy Policy, Refund Policy, and any additional conditions displayed on a service or checkout page.
If you do not agree with these Terms, you must not use our website or purchase our services.
Where you place an order on behalf of a company, organization, channel, page, brand, or another person, you confirm that you have the necessary authorization to accept these Terms on their behalf.
3. Eligibility
You must be legally capable of entering into a binding agreement under the laws applicable to you.
If you are under the legal age required to enter into a contract in your country, you may only use SMPSocial with the involvement and permission of a parent or legal guardian.
You may not use our services if doing so would violate any applicable law, regulation, court order, sanctions requirement, or third-party platform policy applicable to you.
4. User Accounts
Certain services may require you to create an account.
You agree to:
- Provide accurate and current information.
- Keep your account information updated.
- Protect your password and login credentials.
- Accept responsibility for activity performed through your account.
- Notify us promptly if you believe your account has been accessed without authorization.
You may not create accounts using false identities, impersonate another person, or use another person's payment information without permission.
SMPSocial will never require your social media account password to deliver standard promotional services. You should never provide your social media password through an order form or support message.
5. Service Information
We make reasonable efforts to describe each service accurately. However, delivery methods, availability, speed, retention, quality, and results may vary because social media platforms are operated by independent third parties.
Estimated delivery times are estimates and are not guaranteed deadlines unless a specific written guarantee is displayed on the service page.
An order may be delivered gradually rather than all at once. Delivery speed may change depending on order volume, platform restrictions, technical conditions, service availability, and the size of the order.
SMPSocial may temporarily pause, limit, replace, or discontinue a service when required for technical, security, legal, quality-control, or platform-related reasons.
6. Customer Responsibilities
Before submitting an order, you are responsible for ensuring that:
- The username, channel, page, post, profile, group, video, or other submitted link is correct.
- The submitted content is publicly accessible when public access is required for delivery.
- The account or content is not restricted in a way that prevents delivery.
- The order details and selected quantity are correct.
- You have permission to promote or manage the submitted account or content.
- Your use of the service complies with applicable laws and platform rules.
SMPSocial is not responsible for delays, delivery failures, or losses caused by incorrect links, changed usernames, private accounts, deleted content, restricted profiles, disabled pages, incorrect order information, or other conditions controlled by the customer.
7. Public Access Requirement
Where a service requires access to a public account, channel, profile, page, post, group, or video, the relevant content must remain public until the order has been fully delivered.
Changing the username, link, privacy settings, account type, channel address, post address, or other identifying information while an order is active may interrupt or prevent delivery.
Orders affected by customer-controlled changes may not qualify for cancellation, refund, or refill.
8. Simultaneous and Duplicate Orders
You should not place multiple orders for the same service, account, channel, post, or link at the same time unless our support team has confirmed that it is safe to do so.
You should also avoid ordering an identical service from another provider while an SMPSocial order is active.
Simultaneous services can interfere with tracking and make it impossible to determine which provider delivered or lost a particular quantity. SMPSocial is not responsible for incorrect counts, delivery interference, overdelivery, underdelivery, or refill-tracking problems caused by overlapping orders.
9. Prices and Payments
All prices are displayed on the website before checkout. Prices may change at any time, but a price change will not affect an order that has already been paid for and confirmed.
You agree to provide valid and authorized payment information.
Depending on the selected payment method, transactions may be processed by an independent payment provider. SMPSocial does not control the availability, fees, exchange rates, verification procedures, or processing times of third-party payment providers.
You are responsible for any taxes, payment-provider charges, blockchain fees, currency-conversion costs, or other charges imposed by third parties unless expressly stated otherwise.
An order is not considered accepted until payment has been successfully confirmed.
10. Order Acceptance
Submitting payment does not automatically guarantee that an order can be fulfilled.
SMPSocial may reject, cancel, or limit an order when:
- The submitted information is incorrect or incomplete.
- The requested service is temporarily unavailable.
- The order presents a technical, security, legal, or fraud risk.
- The submitted content violates these Terms.
- The order cannot be delivered under the current conditions of the relevant platform.
- The payment is unauthorized, disputed, reversed, or considered suspicious.
If we cannot fulfill a paid order for reasons attributable to SMPSocial or service unavailability, the applicable refund provisions below will apply.
11. Order Delivery
Delivery begins after payment confirmation and successful validation of the submitted order information.
Order status information is provided for convenience. A status such as “Processing,” “In Progress,” or “Completed” is based on our system records and the information available to us at that time.
Minor differences in displayed social media statistics may occur because platforms can update, delay, filter, round, or recalculate public counts.
Delivery may take longer during periods of high demand, platform updates, technical maintenance, security restrictions, or circumstances beyond our reasonable control.
12. Cancellation Policy
You may request cancellation before processing has started.
Once an order has entered processing or delivery has begun, cancellation may no longer be technically possible.
Submitting a cancellation request does not guarantee that the order can be stopped. You should contact our support team as soon as possible and provide the relevant order number.
If an order is successfully cancelled before any service has been delivered, the amount paid for that order will be refunded.
13. Refund Policy
SMPSocial provides refunds when a paid order cannot be completed.
13.1 Orders That Cannot Be Started
If SMPSocial is unable to start or provide the purchased service, you will receive a refund for the amount paid for that service.
13.2 Partially Completed Orders
If an order is only partially completed and SMPSocial is unable to deliver the remaining quantity, you will receive a proportional refund for the undelivered portion.
For example, if 70% of an order has been delivered and the remaining 30% cannot be completed, the refund will normally be calculated based on the undelivered 30%.
13.3 Completed Orders
Once the purchased quantity has been successfully delivered, the order is considered completed and is generally not eligible for a refund.
Eligible drops after completion are handled under the applicable refill guarantee rather than through a cash refund.
13.4 Customer-Controlled Problems
A refund may not be available where delivery is prevented or interrupted because:
- The customer submitted an incorrect or incomplete link.
- The account, channel, page, post, group, or profile was made private.
- The username or link was changed.
- The relevant content was deleted, restricted, suspended, or disabled.
- The customer ordered the wrong service or quantity.
- Another order interfered with delivery or tracking.
- The customer prevented access required for delivery.
- The customer violated these Terms or applicable law.
SMPSocial will make reasonable efforts to help correct an order where technically possible, but correction is not guaranteed.
13.5 Change of Mind
Refunds are not normally provided solely because a customer changes their mind after processing or delivery has started.
This provision does not limit any mandatory cancellation or consumer rights that cannot legally be excluded under applicable law.
13.6 Refund Method
Approved refunds will normally be returned through the original payment method where technically possible.
Where the original payment method does not support refunds, is no longer available, or involves irreversible cryptocurrency transactions, SMPSocial may offer another reasonable refund method or account credit after coordinating with the customer.
Blockchain transaction fees, payment-processing fees, currency-conversion costs, and other non-refundable third-party charges may be deducted where they were not received or retained by SMPSocial.
13.7 Refund Processing Time
Refund processing times depend on the selected payment provider, bank, card network, cryptocurrency network, or other third-party payment system.
After SMPSocial submits an approved refund, we are not responsible for delays caused by the payment provider.
14. Six-Month Member Refill Guarantee
Member orders purchased from SMPSocial include a six-month refill guarantee unless a different refill period or condition is clearly stated on the relevant service page.
The refill period begins on the date the order is marked as completed.
If members delivered through an eligible order drop during the six-month guarantee period, you may submit a refill request through our support system.
14.1 What the Refill Guarantee Covers
The refill guarantee covers eligible losses from the quantity delivered through the applicable SMPSocial member order.
The guarantee is intended to restore eligible dropped members up to the quantity originally delivered under the order. It does not guarantee permanent retention beyond the stated six-month period.
The refill guarantee does not restart or extend after a refill is completed. All refills remain subject to the original six-month period calculated from the initial completion date.
14.2 Requirements for a Refill
To qualify for a refill:
- The six-month refill period must still be active.
- You must provide the correct SMPSocial order number.
- The relevant account, channel, group, or page must remain active and publicly accessible where required.
- The username or submitted link must not have been changed.
- The loss must be measurable and verifiable.
- You must not have placed overlapping member orders from SMPSocial or another provider that prevent accurate tracking.
- The account must not have been deleted, suspended, restricted, transferred, or fundamentally changed.
- The loss must relate to members delivered through the eligible SMPSocial order.
14.3 Refill Limitations
The refill guarantee does not cover:
- Members that existed before the SMPSocial order.
- Organic members gained or lost independently of our service.
- Losses caused by changing the username, link, privacy settings, or account details.
- Losses caused by deletion, suspension, restriction, migration, or removal of the account, channel, page, or group.
- Losses that cannot be verified because of overlapping orders.
- Intentional removal of members by the customer or an account administrator.
- Orders for services that are expressly marked as non-refill or have a different guarantee period.
- Refill requests submitted after the six-month guarantee period has expired.
Refills are subject to technical availability and the operating conditions of the relevant social media platform. Refill delivery times may vary.
15. No Guarantee of Business Results
SMPSocial guarantees only the specific service quantity and applicable refill conditions described on the relevant service page and in these Terms.
We do not guarantee:
- Increased sales, revenue, profit, or customers.
- Monetization approval.
- Verification or account badges.
- Search engine rankings.
- Social media recommendations or algorithmic reach.
- Organic engagement.
- Advertising approval.
- Sponsorships or partnerships.
- Account safety or immunity from platform enforcement.
- Any specific commercial, reputational, or marketing outcome.
The performance of social media content depends on many factors outside our control.
16. Third-Party Platforms
Our services interact with or relate to third-party platforms that are independently operated.
Third-party platforms may change their algorithms, rules, interfaces, limits, statistics, security systems, or enforcement practices without notice.
SMPSocial is not responsible for:
- Platform outages or technical failures.
- Algorithm changes.
- Delayed or inaccurate public statistics.
- Content removal.
- Account restrictions, suspensions, or bans.
- Platform policy changes.
- Reduced reach or engagement.
- Actions taken by a third-party platform against a user or account.
You are solely responsible for reviewing and complying with the terms and policies of every platform you use.
17. Acceptable Use
You may use SMPSocial only for lawful purposes.
You may not use our website or services to:
- Promote illegal products, services, or activities.
- Facilitate fraud, scams, phishing, theft, or financial deception.
- Impersonate another person or organization.
- Harass, threaten, exploit, or target another person.
- Promote violence, terrorism, hate, or unlawful discrimination.
- Distribute malware, spyware, malicious code, or harmful files.
- Manipulate elections or engage in unlawful political influence activities.
- Promote child exploitation or any content involving abuse of minors.
- Infringe copyrights, trademarks, privacy rights, publicity rights, or other legal rights.
- Generate deceptive testimonials, fraudulent reviews, or false claims.
- Circumvent security systems or interfere with the website.
- Resell or misuse our services in a way that causes harm to SMPSocial, its users, or third parties.
We may reject or cancel any order that we reasonably believe violates this section.
18. Fraud Prevention
SMPSocial may use automated and manual fraud-prevention measures.
We may request additional information when necessary to verify a payment, account, order, or identity. We may delay, limit, reject, or cancel transactions that appear unauthorized, fraudulent, abusive, or unusually risky.
Customers must contact our support team before initiating a payment dispute or chargeback so that we have a reasonable opportunity to investigate and resolve the issue.
Fraudulent or abusive payment disputes may result in account suspension, service termination, and submission of relevant evidence to the payment provider.
19. Intellectual Property
The SMPSocial website, brand name, logo, design, software, text, graphics, databases, service descriptions, and other original materials are owned by or licensed to SMPSocial and are protected by applicable intellectual-property laws.
You may not copy, reproduce, scrape, republish, modify, sell, distribute, reverse-engineer, or commercially exploit our website or original content without prior written permission.
Third-party names, trademarks, logos, and platform names remain the property of their respective owners. Their appearance on our website does not imply endorsement or affiliation.
20. Customer Content
You retain ownership of the content, links, usernames, and materials you submit.
By submitting information required to fulfill an order, you grant SMPSocial a limited, non-exclusive permission to access, process, and use that information solely to provide the requested service, operate the website, prevent fraud, provide support, and comply with legal obligations.
You confirm that you have the legal right and necessary permission to submit the content and request the service.
21. Privacy and Data Protection
Our collection and use of personal information are governed by our Privacy Policy.
By using SMPSocial, you acknowledge that certain information may be processed to:
- Create and manage accounts.
- Process orders and payments.
- Provide customer support.
- Prevent fraud and abuse.
- Maintain website security.
- Improve services.
- Comply with applicable legal obligations.
You should review the SMPSocial Privacy Policy before using the website.
22. Website Availability
We aim to keep the website available and functioning correctly, but uninterrupted access cannot be guaranteed.
The website may occasionally be unavailable because of maintenance, updates, hosting problems, cyberattacks, third-party failures, network issues, technical errors, or events beyond our reasonable control.
We may modify, suspend, or discontinue any website feature without prior notice where reasonably necessary.
23. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the website and services are provided on an “as available” and “as described” basis.
Except for the express refund and refill commitments stated in these Terms or on a service page, SMPSocial does not provide additional express or implied warranties regarding uninterrupted availability, merchantability, fitness for a particular purpose, non-infringement, permanent retention, or specific results.
Nothing in these Terms excludes any warranty or consumer protection that cannot legally be excluded.
24. Limitation of Liability
To the maximum extent permitted by applicable law, SMPSocial will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including loss of profit, revenue, business opportunity, reputation, data, audience, account access, or anticipated savings.
SMPSocial is not liable for actions taken by social media platforms, payment providers, hosting companies, internet providers, banks, cryptocurrency networks, or other independent third parties.
Where liability cannot legally be excluded, SMPSocial’s total liability relating to a particular order will not exceed the amount actually paid to SMPSocial for that order.
This limitation does not apply where liability cannot be limited under applicable law.
25. Indemnification
To the extent permitted by law, you agree to indemnify and hold SMPSocial and its operators, employees, contractors, and service providers harmless from claims, damages, liabilities, losses, and reasonable expenses arising from:
- Your unlawful use of the website or services.
- Your violation of these Terms.
- Your violation of third-party rights.
- Content or information submitted by you.
- Fraudulent, abusive, or unauthorized activity performed through your account.
This section does not require you to indemnify SMPSocial for losses caused solely by SMPSocial’s own unlawful conduct.
26. Suspension and Termination
We may suspend or terminate access to an account or service if a user:
- Violates these Terms.
- Uses the service unlawfully.
- Engages in fraud, payment abuse, or chargeback abuse.
- Threatens the security or operation of the website.
- Harasses staff, contractors, customers, or other users.
- Uses the service in a manner that creates legal, technical, or reputational risk.
- Fails to pay amounts lawfully due.
Termination does not remove payment obligations or legal rights that arose before termination.
Where appropriate and legally required, eligible refunds for undelivered services will still be handled under the Refund Policy.
27. Changes to Services and Prices
We may add, remove, modify, rename, or replace services at any time.
Prices, estimated delivery times, refill periods, descriptions, and service availability may also change.
Changes will apply to future orders and will not retroactively remove the express refund or refill protection applicable to an already confirmed order, unless the change is required by law or is more favorable to the customer.
28. Changes to These Terms
We may update these Terms and Conditions to reflect changes in our services, payment methods, legal obligations, business practices, or third-party platform requirements.
The revised version will be published on this page with an updated “Last Updated” date.
Material changes will apply from the date stated in the revised Terms. Your continued use of SMPSocial after the effective date constitutes acceptance of the updated Terms, to the extent permitted by law.
29. Governing Law and Disputes
These Terms are governed by the laws applicable in the jurisdiction where the legal operator of SMPSocial is established, without excluding mandatory consumer protections that apply in the customer’s country of residence.
Before starting formal legal proceedings, you agree to contact SMPSocial and make a reasonable attempt to resolve the dispute through customer support.
Where the law permits the parties to choose a court, disputes will be submitted to the competent courts in the jurisdiction where the legal operator of SMPSocial is established.
Nothing in this section removes any mandatory right a consumer may have to bring a claim in another legally required jurisdiction.
30. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to remain in effect.
The invalid provision will be interpreted or modified only to the minimum extent necessary to make it valid and enforceable where permitted by law.
31. No Waiver
A failure or delay by SMPSocial in enforcing any provision of these Terms does not waive our right to enforce that provision or any other provision later.
32. Entire Agreement
These Terms, together with the Privacy Policy, Refund Policy, service-page conditions, and any other policies expressly incorporated into them, constitute the entire agreement between you and SMPSocial regarding your use of the website and services.
If a service page contains a specific condition that conflicts with a general provision in these Terms, the specific service-page condition will apply to that service, provided that it is clearly disclosed before purchase.
33. Contact Us
For questions regarding these Terms, an order, a refund, or a refill request, please contact SMPSocial through the support or contact section available on our website.
When contacting support about an order, please include your order number and the email address associated with the order so that we can assist you efficiently.
